Welcome to MUNCH (“MUNCH”, “we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website munchlocal.com.au and any related pages (the “Site”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Who can use the Site

You may use the Site only if you are at least 13 years old. If you are under 18, you must have permission from a parent or legal guardian. You agree to comply with Australian laws and regulations.

Acceptable use

You agree not to:

  • Harass, abuse, harm, or impersonate others;
  • Post or transmit unlawful, obscene, misleading, or infringing content;
  • Interfere with or disrupt the Site (including introducing malware, scraping, reverse engineering, bypassing security or rate limits);
  • Use the Site for any commercial solicitation without our written consent.

We may suspend or terminate access for any breach of these Terms.

Your content

If you submit or post content to us (e.g., testimonials or feedback), you grant MUNCH a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content for operating, promoting or improving the Site and our communications. You warrant you have the rights to grant this licence.

Intellectual property

All content, trademarks, logos and materials on the Site are owned by MUNCH or our licensors and are protected by Australian and international laws. You may not copy, reproduce, modify, distribute or exploit any part of the Site without our prior written permission.

Privacy & electronic communications

When you provide your email or other details, you consent to us handling your personal information in line with our Privacy Policy. You can unsubscribe from marketing at any time via the link in our emails.

Third-party services

We operate the Site on Shopify and send emails via Shopify Email (our current email service provider). These providers process your information on our behalf and are subject to their own terms and privacy policies. We may change providers from time to time.

Information only (no warranties)

The Site is provided for general information. We aim for accuracy but make no warranties (express or implied) about the Site’s completeness, reliability, availability or fitness for a particular purpose. You use the Site at your own risk.

Australian Consumer Law (ACL)

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot be excluded (“Non-Excludable Rights”). Where it is lawful to do so, our liability for a failure to comply with a Non-Excludable Right in connection with services is limited, at our option, to resupplying the services or paying the cost of resupplying the services.

Liability

Subject to the Non-Excludable Rights:

  • the Site is provided “as is” and we exclude all warranties and representations not expressly set out in these Terms; and
  • our aggregate liability to you arising out of or in connection with the Site is limited to the greater of AUD $500 or the amounts you paid to us (if any) in the 12 months before the claim.

The above limitation does not apply to liability arising from our fraud or wilful misconduct, or to your Non-Excludable Rights.

Third-party links

The Site may contain links to third-party websites. We are not responsible for their content, policies or practices. Accessing third-party sites is at your own risk.

Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control (e.g., internet or platform outages, acts of God, governmental action).

Changes, suspension & termination

We may update the Site or these Terms from time to time. Changes take effect when posted on the Site, and your continued use means you accept the updated Terms. We may suspend or terminate the Site or your access at any time (including for maintenance, security or misuse).

Governing law

These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth courts of Australia.
